That rate applies to nearly every employee in the private sector.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Minimum Wage Increases<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Every year, the Industrial Commission of Arizona (ICA) recalculates the state minimum wage based on inflation and announces the new figure in the fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Employers have to follow ICA guidelines. They must also post the new rate in a conspicuous location.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How Arizona Ended Up With This Law<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Back in 2016, voters passed Proposition 206, also known as the Fair Wages and Healthy Families Act.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s what the law did:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Created a multi-year hike from 2017 to 2020<\/li>\n\n\n\n<li>Locked in annual inflation-based increases in the future<\/li>\n\n\n\n<li>Gave workers the right to sue directly if wages went unpaid<\/li>\n\n\n\n<li>Banned employer retaliation against employees who speak up<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This isn\u2019t federal law. It\u2019s statewide for Arizona, and it overrides the federal minimum of $7.25.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who Gets Minimum Wage in Arizona?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Short answer: almost everyone. The law doesn\u2019t care whether you work full-time or part-time, year-round or just for the summer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It doesn\u2019t matter if you\u2019re on the books, off the books, salaried, tipped, or getting paid in cash. If you\u2019re working, there\u2019s a good chance the wage law covers you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This even includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Hourly workers<\/li>\n\n\n\n<li>Servers, bartenders, and others who earn tips (with some conditions)<\/li>\n\n\n\n<li>Restaurant, hospitality, and retail staff<\/li>\n\n\n\n<li>People getting paid under the table<\/li>\n\n\n\n<li>Independent contractors who were misclassified<\/li>\n\n\n\n<li>Home health aides, cleaners, and live-in caregivers<\/li>\n\n\n\n<li>Undocumented workers<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Immigration status doesn\u2019t change the pay rules. Arizona law still applies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Are There Any Exceptions?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are only a few narrow exceptions to the law:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tipped employees can be paid $11.70\/hour, but only if tips push their total up to at least $14.70\/hour<\/li>\n\n\n\n<li>Federal and state government workers may fall under different systems<\/li>\n\n\n\n<li>Volunteers and unpaid interns may not be protected, depending on the arrangement<\/li>\n\n\n\n<li>Some small businesses might not have to follow federal rules, but they still have to follow Arizona\u2019s<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">What doesn\u2019t count as an exemption? Working part-time. Getting paid in cash. Being labeled \u201cseasonal\u201d or \u201ctemporary.\u201d None of that overrides the minimum wage floor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Enforcement: Who Handles Minimum Wage Requirements<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Industrial Commission of Arizona (ICA) is the agency in charge of enforcing wage laws.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>ICA Requirements<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Employers are legally required to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pay at least $14.70\/hour to anyone covered<\/li>\n\n\n\n<li>Pay tipped workers at least $11.70\/hour in direct wages<\/li>\n\n\n\n<li>Post a current minimum wage notice where employees can see it<\/li>\n\n\n\n<li>Keep payroll and time records for at least four years<\/li>\n\n\n\n<li>Apply the annual cost-of-living increase on January 1<\/li>\n\n\n\n<li>Avoid retaliating against employees who ask questions or file complaints<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, you don\u2019t have to wait for ICA to get involved. Arizona law lets you file a lawsuit without going through an agency process first.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Happens If Employers Violate State Minimum Wage Laws<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Employers who violate minimum wage requirements have to resolve the issue financially.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They could owe:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unpaid wages<\/li>\n\n\n\n<li>Double damages (you get what they owe you, plus that amount again)<\/li>\n\n\n\n<li>Your legal fees<\/li>\n\n\n\n<li>Up to $1,000 per violation in fines<\/li>\n\n\n\n<li>Daily fines for every day they keep violating the law<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If they tampered with records or intentionally concealed their actions, criminal charges may be possible.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Tucson\u2019s Higher Minimum Wage Rates<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Arizona lets cities set a higher minimum wage than the state rate due to cost of living differences.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As such, the 2025 minimum wage in Tucson is $15.00 per hour. That\u2019s higher than the state level and higher than most surrounding areas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Tucson\u2019s Local Law Requires<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Tucson Minimum Wage Act was passed in 2021. It outlined a wage increase schedule and granted the city full enforcement authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Key parts of the law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It applies to any private employer with one or more employees<\/li>\n\n\n\n<li>It covers workers who spend at least five hours per week working inside Tucson city limits<\/li>\n\n\n\n<li>It allows a $3.00 tip credit, meaning base pay for tipped workers must be at least $12.00\/hour<\/li>\n\n\n\n<li>Employers have to post notices in multiple languages<\/li>\n\n\n\n<li>There are fines for breaking the rules<\/li>\n\n\n\n<li>Workers have the right to sue directly<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the work happens in Tucson, the city\u2019s rate applies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What If You Only Work in Tucson Occasionally?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You\u2019re still covered if you work in Tucson five hours or more per week.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some employers attempt to circumvent this by adjusting schedules or reassigning shifts elsewhere.
