VA Disability Claim in South Carolina<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The quickest and easiest way to apply for VA benefits is to apply online. You can also submit your completed application to your local VA Regional Office by mail, fax, or in person. In South Carolina, the VA regional office is located in<a href=\"https:\/\/www.benefits.va.gov\/Chicago\/\"> <\/a><a href=\"http:\/\/www.benefits.va.gov\/Columbia\/\">Columbia<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regardless of which filing option you choose, you must prove three things to receive disability compensation:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You qualify as an eligible veteran<\/li>\n\n\n\n<li>You have a current disability<\/li>\n\n\n\n<li>Your current disability service-related<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Are You an Eligible Veteran?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To qualify as a veteran eligible to receive VA benefits, your active duty service must fall within a time period that the VA recognizes. You can usually establish this through your military service records, including your DD Form 214.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you\u2019ve received a<a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/military-discharge-upgrade-lawyer\/\"> dishonorable discharge<\/a> or an<a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/military-records-correction-lawyer\/\"> other-than-honorable discharge<\/a>, it may be better to first see if you can work with an experienced VA benefits attorney to improve your discharge by appealing to the VA.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Do You Have a Disability?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The VA defines a disability as a current physical or mental illness or impairment that your active duty military service either caused or made worse. You may be eligible for compensation from the VA if your service-related disability makes you less than 100% able-bodied, which can be proved with medical records.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Is Your Disability Service Connected?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The VA decides whether you have a service-connected disability on a case-by-case basis. Your service medical records and any records of post-service medical treatment you have received will be part of the claims evidence the VA will consider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although some medical conditions, known as<a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/agent-orange-exposure-attorney\/\"> presumed disabilities<\/a>, do not require you to prove a connection to military service, most still require you to prove a service connection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA rejects many disability claims because they lack sufficient evidence to create a service connection. One of our South Carolina VA disability attorneys at Stone Rose Law can help you gather all the documents and other support you need to clear this potential obstacle to your benefits claim approval.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Other Ways to Meet the Service Connection Requirement<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">What follows are some specific medical conditions the VA will consider in addition to disabilities that arose directly because of a service-connected disabling event.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Latent Conditions<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A latent condition is one you had when you entered military service but has not yet become disabling. If your latent condition becomes worse after you leave the service, the VA will decide whether something happened to you while serving to aggravate it.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Secondary Source Conditions<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Another way you can receive a service-connected disability is if it comes from a separate disability that itself is service-connected.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, your doctor might diagnose you as having<a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/post-traumatic-stress-disorder-ptsd-attorney\/\"> post-traumatic stress disorder<\/a> (PTSD) based on a traumatic event you experienced while in service. If your PTSD treatment includes drugs that have a side effect of contributing to significant weight gain, this additional weight could eventually cause you to be diagnosed later on with Type 2 Diabetes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These events make it possible to trace a secondary service connection by showing that the PTSD treatment caused your diabetes.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Non-Service-Connected Disabling Events<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The VA will deny your claim if your injury, illness, or disabling condition results from doing something unrelated to a service-connected condition.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the VA Disability Ratings?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If the VA approves your initial or additional disability compensation claim, it will assign you a<a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/how-are-disability-ratings-determined\/\"> VA disability rating<\/a>. Your rating will range from 0% (non-compensable) to 100% for totally disabled veterans.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Factors that go into deciding your disability rating include whether you have multiple disabilities (most veteran claims for benefits are for more than one) and the severity of each disability.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA uses a formula to determine your combined disability rating if you have more than one disability. The higher your overall disability rating, the more you can receive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For 2026, the disability rating compensation for an individual veteran is as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Your Combined VA Disability Rating<\/strong><\/td><td><strong>VA 2026 Monthly Compensation<\/strong><\/td><\/tr><tr><td>10%<\/td><td>$180.42<\/td><\/tr><tr><td>20%<\/td><td>$356.66<\/td><\/tr><tr><td>30%<\/td><td>$552.47<\/td><\/tr><tr><td>40%<\/td><td>$795.84<\/td><\/tr><tr><td>50%<\/td><td>$1,132.90<\/td><\/tr><tr><td>60%<\/td><td>$1,435.02<\/td><\/tr><tr><td>70%<\/td><td>$1,808.45<\/td><\/tr><tr><td>80%<\/td><td>$2,102.15<\/td><\/tr><tr><td>90%<\/td><td>$2,362.30<\/td><\/tr><tr><td>100%<\/td><td>$3,938.58<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">These monthly payments increase for disabled veterans with dependents.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Additional Monthly Compensation for Qualifying Dependents&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you have one or more dependents, and your combined disability rating is at least 30%, then you can qualify for additional monthly compensation depending on how many qualifying dependents you have.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A qualifying dependent can include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your spouse<\/li>\n\n\n\n<li>Your dependent parent or parents<\/li>\n\n\n\n<li>Your children who are under the age of 18<\/li>\n\n\n\n<li>Your children between the ages of 18 and 23 who are still in a course of study<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Additional Special Monthly Compensation for Qualifying Disabled Veterans<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Special monthly compensation (SMC) is available if you are a disabled veteran whose service-connected disability is severe enough that you need more than what a 100% disability rating provides.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SMC is available depending on criteria including specific disabilities like the loss of a limb or creative organ, whether you need aid and attendance from someone else, if you are completely and permanently housebound, or if you have suffered a traumatic brain injury and need regular aid and attendance as a result.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Except for SMC category K, SMC benefits replace the monthly compensation benefit you would otherwise receive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA rates SMC benefits through the letters K, L, M, N, O, P, R, S, and T.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The L, M, and N categories also have an additional \u201c\u00bd\u201d rating.<\/li>\n\n\n\n<li>The R and S levels each have two numbered subcategories (R-1 and R-2 and S-1 and S-2).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Here are the 2026 SMC compensation amounts.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Your SMC Category<\/strong><\/td><td><strong>Your 2026 SMC Monthly Benefit<\/strong><\/td><td><strong>Notes<\/strong><\/td><\/tr><tr><td>K<\/td><td>$139.87<\/td><td>Paid in addition to your 100% monthly disability compensation<\/td><\/tr><tr><td>L<\/td><td>$4,900.83<\/td><td><\/td><\/tr><tr><td>L-\u00bd&nbsp;<\/td><td>$5,154.39<\/td><td><\/td><\/tr><tr><td>M<\/td><td>$5,408.55<\/td><td><\/td><\/tr><tr><td>M-\u00bd&nbsp;<\/td><td>$5,780.44<\/td><td><\/td><\/tr><tr><td>N<\/td><td>$6,152.64<\/td><td><\/td><\/tr><tr><td>N-\u00bd&nbsp;<\/td><td>$6,514.44<\/td><td><\/td><\/tr><tr><td>O and P<\/td><td>$6,877.12<\/td><td>No difference in pay between these two categories<\/td><\/tr><tr><td>R-1<\/td><td>$9,826.88<\/td><td><\/td><\/tr><tr><td>R-2 and T<\/td><td>$11,271.67<\/td><td>No difference in pay between these two categories<\/td><\/tr><tr><td>S<\/td><td>$4,408.53<\/td><td><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dependency and Indemnity Compensation for 2026<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you are a qualifying surviving dependent of a veteran whose death was caused by that person\u2019s military service, then you may be eligible for dependency and indemnity compensation, or DIC.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The base DIC monthly compensation amount for 2026 is $1,699.36.
