{"id":5429,"date":"2023-03-30T14:53:15","date_gmt":"2023-03-30T21:53:15","guid":{"rendered":"https:\/\/www.stoneroselaw.com\/veteranslaw\/?p=5429"},"modified":"2025-08-11T15:49:49","modified_gmt":"2025-08-11T22:49:49","slug":"beware-of-claims-consultation-companies","status":"publish","type":"post","link":"https:\/\/www.stoneroselaw.com\/veteranslaw\/beware-of-claims-consultation-companies\/","title":{"rendered":"Beware Of \u201cCLAIMS CONSULTATION\u201d Companies"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In order for anyone to assist a veteran in the preparation, presentation, or prosecution of a claim or appeal for VA benefits, that individual or agency must be <strong>accredited<\/strong> by the Department of Veteran\u2019s Affairs. In order to be accredited by the VA, an individual must either:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Be a licensed attorney in good standing and submit the application form and required documents; or<\/li>\n\n\n\n<li>Pass an accreditation examination and submit an application form and required documents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">By becoming an accredited attorney or claims agent, an individual providing assistance with VA claims is bound by a set of rules and ethics. Specifically, and most importantly, <a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/philadelphia-veterans-affairs-va-disability-lawyers\/\">accredited attorneys<\/a> and agents are governed by strict rules pertaining to <em>when<\/em> they may charge a fee for services and <em>how much<\/em> of a fee they may charge.<\/p>\n\n\n\n<div class=\"wistia_responsive_padding\" style=\"padding:56.25% 0 0 0;position:relative\"><div class=\"wistia_responsive_wrapper\" style=\"height:100%;left:0;position:absolute;top:0;width:100%\"><div class=\"wistia_embed wistia_async_lqojenvu1a seo=true videoFoam=true\" style=\"height:100%;position:relative;width:100%\"><div class=\"wistia_swatch\" style=\"height:100%;left:0;opacity:0;overflow:hidden;position:absolute;top:0;width:100%\"><img decoding=\"async\" src=\"https:\/\/fast.wistia.com\/embed\/medias\/lqojenvu1a\/swatch\" style=\"height:100%;object-fit:contain;width:100%\" alt=\"\" aria-hidden=\"true\" \/><\/div><\/div><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">How And When An Attorney May Charge A Fee<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">VA rules are crystal clear. As a condition of accreditation, attorneys and claims agents <strong>can not<\/strong> charge a fee for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An initial application for benefits<\/li>\n\n\n\n<li>A request for an increase for disability benefits more than one year after a rating decision.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And while it is permissible to charge a fee for the initial consultation, the vast majority of attorneys do not. <strong>We here at Stone Rose Law do not charge and will never charge a fee for an initial consultation.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These VA rules are because the VA has a very broad statutory duty to assist claimants in perfecting and proving their claims. Accordingly, Congress has deemed that veterans should not be forced to pay an attorney or agent to assist them in obtaining their benefits when the VA is supposed to help them. (Surprise, though, many times the VA fails in their statutory duty to assist).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, an accredited agent or <a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/new-jersey-va-disability-lawyer\/\">attorney<\/a> may only charge a fee if the following conditions are met:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An appeal of an initial VA decision is filed;<\/li>\n\n\n\n<li>The appeal is successful (for contingency fees); AND<\/li>\n\n\n\n<li>The appeal results in an award of past due benefits (if the fee is contingency)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When those conditions are met, an attorney may charge a fee. The fee may be an hourly rate, a flat fee, or a percentage of the past-due benefits (also known as a contingency fee). Regardless of how the fee is calculated, the total fee must be reasonable in light of the complexity of the case, the amount of work performed, and other factors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most importantly, when a veteran works with an accredited agent or attorney, they have recourse if they believe the fee they\u2019ve paid is unreasonable. All Agent\/Attorney fees are reviewable by the Board of Veterans Appeals for reasonableness.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Danger of \u201cClaims Consultation Companies\u201d<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Needless to say, claims consultation companies \u2013 which would be listed here if they didn\u2019t close down shop and change names so frequently \u2013 are not bound by the same ethical rules as attorneys. These companies attempt to skirt the boundaries of \u201cpreparing\u201d a claim by pretending they merely \u201cconsult\u201d on a claim or \u201cassist\u201d a veteran in obtaining evidence to submit their own claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, there is no difference between assisting a veteran in obtaining evidence for their claim and assisting the veteran in preparing their claim. They are quite literally the exact same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Second, these \u201cclaims consultants\u201d charge EXORBITANT rates for their \u201cservices\u201d \u2013 sometimes as much as 5x the amount of increase they obtain for the veteran!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Third, these \u201cclaims consultant\u201d companies quite frequently prepare and submit fraudulent <a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/idaho-va-disability-lawyer\/\">disability<\/a> benefits questionnaires in connection for benefits claims.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Is Working With A Claims Consultant So Dangerous For Your VA Disability?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As many people are aware, VA ratings develop additional statutory protections after 5, 10, and 20 years. However, regardless of how long a <a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/fort-worth-tx-veterans-affairs-va-disability-and-benefits-lawyer\/\">VA disability<\/a> rating has been in effect, it may always be severed for fraud. This is important for individuals who have used these types of companies in the past because the VA keeps a detailed list of physicians. Indeed, they even keep a \u201cblack list\u201d of doctors whose opinions have been found to be inaccurate or fraudulent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, The VA\u2019s Office of General Counsel and Office of the Inspector General have become laser-focused on VA disability fraud over the last few years. It is inevitable that OGC and OIG will, sooner or later, begin digging into claims that rest upon these well-known quack medical exam\/opinion providers. And unfortunately, because these \u201cclaims consultants\u201d do not formally represent the veteran, the risk is entirely on the veteran themselves \u2013 who almost always believes they have hired an accredited agent or <a href=\"https:\/\/www.stoneroselaw.com\/veteranslaw\/austin-veterans-va-disability-and-benefits-lawyer\/\">attorney<\/a> to provide legal representation to them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When OIG and OGC start looking into these cases in more detail, there will be a drastic backlash in VA benefits reductions, overpayment recoupment, or even potential criminal fraud cases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Don\u2019t Risk Your Future<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">VA Claims consultation companies promise quick results that are almost too good to be true. However, they do not provide legal representation and are not legally authorized to provide the services they purport to provide. Even if their consultation is successful, the Veteran is left paying an exorbitant and unlawful fee and is jeopardizing their future livelihood and freedom.
