Am I Required to Wear a Motorcycle Helmet in Arizona?

Posted on June 30, 2022 in

Being injured in an accident caused by someone or something else will entitle you to compensation for the related costs and damages, but what if you contributed to the accident? When a person is injured while riding a motorcycle without a helmet, whether or not they are legally obligated to wear a helmet, and whether they were wearing one, will impact the outcome of their case.

If you have been injured in a motorcycle accident, or lost a loved one to a motorcycle accident, it is helpful to explore your options with an experienced attorney who knows what options are available to you. Your local Phoenix motorcycle accident lawyer from Stone Rose Law is available to review the unique facts and circumstances of the accident to determine what your options are to collect what you are entitled to.

Adult Motorcyclists in Arizona Do Not Need to Wear a Motorcycle Helmet

Under Arizona Law HB 2246, only motorcyclists who are under the age of 18 must wear a helmet when on a motorcycle. While they are not legally required, it is important to note that wearing a motorcycle helmet has been shown to dramatically reduce the likelihood of death in a motorcycle accident, and also reduces the likelihood of many serious injuries.

What this law means for motorcyclists is that the insurance company cannot claim that a motorcyclist is liable for their own damages simply because they were not wearing a helmet. You’ll generally be collecting your compensation from an insurance company, which will do whatever possible to reduce or deny your claim.

To collect the complete compensation for your motorcycle accident that you deserve, you must prove that another party was negligent. Negligence has four parts:

  • Duty – the other party must have owed you a duty or responsibility
  • Breach – the duty must have been broken
  • Causation – the broken duty must have caused the accident
  • Damages – there must have been damages from your motorcycle accident to collect

Damages for motorcycle accidents we help our clients collect include:

  • Motorcycle repair or replacement costs
  • Medical bills in the short term (ER bills) and costs in the long-term (rehabilitation, medications, treatment, surgeries, and anything else)
  • Lost wages in the short-term and lost earnings potential in the long-term
  • In some cases, damages for pain and suffering are available

To collect compensation for your motorcycle accident, you’ll first need to prove that another party was negligent. Once another party has been proven as negligent, then you must collect evidence to measure and prove your damages from medical and occupational experts. Your attorney will help schedule appointments with experts to gather the evidence you need to win on your case.
