A single mother and her two children joined friends who owned a boat to go on a lake excursion.
At one point, the boat was towing a floatie attached to the stern by a rope. Two kids under five years old, one of which was the youngest child of the single parent, were on the floatie when suddenly the rope broke.
Seeking to reassure the children, the single mom jumped into the water and began to swim out to the now-detached floatie. The boat owner, seeing the situation, decided to turn the boat around to bring it closer.
Unfortunately, the boat owner, who had put the boat engine in reverse to slow the boat down when the rope broke, neglected to take the engine out of the reverse setting. When the boat owner applied power to the engine, instead of going forward, the boat lurched backward. The engine propeller struck the woman in the water, severing one of her legs at the hip.
The single mother bled to death from her injury. Her estate (The children’s guardian) hired Stone Rose Law to seek compensation for her now-orphaned children in a wrongful death claim.
When settlement negotiations with the boat owner’s insurer began, the original policy liability limit was for only $100,000.
Our wrongful death attorneys, after a thorough investigation, were able to find additional applicable policies of insurance, but then the insurance companies tried to limit the wrongful death claim value to only $50,000 by claiming that federal maritime law governed the accident.
We successfully fought for our clients to overcome this argument. Ultimately, we reached a wrongful death settlement with the combined insurers for $2 million.
